Tek-Collect is reporting a debt on my credit report, but I am still receiving bills directly from the original creditor, ***** **** ****** **********. This raises concerns about who actually owns the debt and whether Tek-Collect has the legal right to collect or report it.
Details of the Issue: I received a recent bill from ***** **** ****** **********, which indicates that they still own the debt. Tek-Collect is reporting the same debt to the credit bureaus. If the debt is still with the original creditor, Tek-Collect should not be reporting or attempting to collect on it. I have attempted to dispute the accuracy of the reporting and clarify who owns the debt, but Tek-Collect has not provided proper validation.
This duplicate collection effort is causing confusion and negatively impacting my credit score.
Desired Resolution: Provide clear proof of debt ownership—either Tek-Collect has the legal right to collect, or ***** **** ****** ********** still owns the account. If Tek-Collect is not the rightful owner, they must remove the account from my credit report immediately. Cease collection efforts if they cannot validate that they have the legal right to collect.
I am requesting BBB’s assistance in resolving this matter, as Tek-Collect’s actions may be in violation of Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA). Thank you for your attention to this issue.

The consumer has filed previous complaints with the Consumer Financial Protection Bureau 11/08/2024 and the credit bureaus on 00/21/2024, 1123/2024, 12/03/2024 and 01/23/2025. I am responding to Tek-Collect’s recent reply to my complaint.While Tek-Collect claims to be the collection agent for ***** **** ******, there are multiple concerning issues regarding their collection efforts:
Duplicate Collection Attempts: ***** **** ****** continues to send me bills directly while Tek-Collect is also attempting to collect on the same debt. This raises serious concerns regarding the validity and ownership of the debt.
Lack of Licensing & Registration in North Carolina: Tek-Collect is not licensed or registered to collect debts in the state of North Carolina. Under North Carolina General Statutes § 58-70-15, collection agencies must be licensed by the North Carolina Department of Insurance to legally conduct business. Since Tek-Collect is unlicensed, their collection efforts may be in violation of state law.
Failure to Provide Proper Validation: While Tek-Collect states they have “validated” the debt, I have not received any documentation proving the legitimacy of this debt under the Fair Debt Collection Practices Act (FDCPA). Simply providing copies of invoices from ***** **** ****** is not sufficient proof of legal ownership of the debt or my liability to pay it.
Requested Actions:
Cease All Collection Efforts: Due to Tek-Collect’s lack of proper licensing in North Carolina, I request that all collection activity immediately cease and desist in accordance with state laws.Remove Any Credit Reporting: Since Tek-Collect is unlicensed to collect in North Carolina, I request that they delete any credit reporting regarding this alleged debt.
Clarify Debt Ownership: ***** **** ****** must clarify whether they still own this debt or if it was legally sold to Tek-Collect. If ***** **** ****** still owns it, Tek-Collect should not be reporting it to the credit bureaus under their name.
If Tek-Collect is unable to prove they are legally licensed in North Carolina, I request that the BBB take action and notify them of potential non-compliance.

TekCollect has provided copies of validation to the consumer on multiple occasions. The documents include a detailed ledger, along with supporting forms and documents with signatures. The consumer has filed complaints and disputes previous to this complaint with the Consumer Financial Protection Bureau, Credit Reporting Agencies and directly with TekCollect.

We have no record or recollection of doing business with this company or any company that associates with this company. As of 1/31/2025, we have been receiving phone calls at all hours of the day and night. The callers have been rude and harass us when we answer. We asked that they remove our number since they can not remain professional. Tek Collect are stating that I owe 632 dollars to a ************ ****** and I do not. I paid that company over 3000 for services. Here are the last of the payments which made the balance below the 632 that they are reporting. Anything lower than 500 in medical bills are not report per the CFPB. I'm requesting that they remove this from my credit report immediately as this is fraudulent and against the law. These companies buy debts for pennies on the dollar and they want you to pay them on amounts that you do not owe.Business Response

TekCollect attempted to collect on debt (****) from a dentist office that is no longer in service. I paid the dentist for their service in full at the time I had the service. When I received a collection notice from TekCollect I called the only number available for the out of business dentist office and I was told that the balance wasn't correct for me. I received an updated invoice from the dentist for $65 (still incorrect, I have no bills with this dentist) as well as an updated invoice from TekCollect for the same $65 amount. TekCollect decided to put a $1005 debt on my Transunion Credit Report even though they sent me an updated amount for only $65. Not only that but they've sold the invalid debt to another collection agency which is harassing me.Business Response

Tekcollect have attempted to collect on a debt which was requested to be substantiated by myself. They did not accommodate NY state law -Specifically “N.Y. Comp. Codes R. & Regs. Tit. 23 § 1.4 - Substantiation of consumer debts “Requirements Regarding “Substantiation” of the Debt Under the new New York regulations, consumers may request “substantiation” of the debt at any time during the collections process, and may do so orally. Once a request is received, the debt collector must provide the consumer written substantiation of a charged-off debt within 60 days of receiving the request. 23 NYCRR § 1.4(b). The debt collector must also cease collection until written substantiation has been provided to the consumer. The regulation further lists the various forms of documentation required to substantiate the debt. “(b) A debt collector must provide the consumer written substantiation of a charged-off debt within 60 days of receiving a request for substantiation of the debt and must cease collection of the debt until written substantiation has been provided to the consumer. A debt collector must substantiate a charged-off debt pursuant to this section only once during the period that the debt collector owns or has the right to collect the debt. (c) Substantiation of a charged-off debt shall include: (1) the signed contract or signed application that created the debt (The document you provided is not signed) or, if no signed contract or application exists, a copy of a document provided to the alleged debtor while the account was active (This document was never received by myself) The document they DID provide me, shows the account satisfied and no longer active, please see my email to * ******* with the proof of this) demonstrating that the debt was incurred by the debtor. On 10/04/2024, the consumer disputed this account stating that his understanding was the account had been paid and if there was money due, he would pay it after receiving an itemized statement. TekCollect contacted the Veterinary Practice and requested the information, which upon receipt, we subsequently sent to the consumer on 10/092024. After this on 10/15/2024, the consumer contacted TekCollect to continue disputing the account. On or around that time TekCollect received from the consumer a document showing the account paid. It should be noted that it showed two transactions one from 10/12/2023 for $3,000 and another from 10/16/2023 for $2,990. Yesterday, TekCollect received a response from the Practice concerning the document, instructing us to close out the account. This morning TekCollect notified Experian, Equifax and TransUnion to delete this account from the consumer's credit files. I am rejecting this response because: Tekcollect have not accepted responsibility by addressing damages caused or acknowledged the mishandling of my case. I am happy to evidence all of my communications after obtaining them in line with State law here in NY.
I have clear evidence that the law was not accommodated to my damage and detriment. I applied for a loan for example a few days after the misrepresentation made by Tekcollect which had adverse impact on the rate offered. Tekcollect have demonstrated clearly on several occasions they sought to enforce debt collection through illegal methods in the face of my rights as a consumer both at state and federal levels.
As per case precedent set by ***** ** *** ******* ************ who On 02/25/2021 ***** filed a Finance - Consumer Credit lawsuit. Case Number *************
I would like to settle this with one off payment privately agreed to, without invoking a court procedure if Tek Collect is agreeable. I am seeking to mitigate further increase of a financial settment by avoiding including the filing fees and lawyers costs that will be present once I raise this with the courts. Coincidentally at this very same court in Southern District NY as the case mentioned.
Please request Tekcollect reach out to me to agree a private settlement to compensate. I also anticipate an email of apology from **** ***, the Supervisor at Tekcollect who oversaw my case handling.
If Tekcollect agree to these terms I will consider the matter fully resolved. If not I will be in touch to pursue legal action individually or as part of a wider class action engagement.

I was called by Tek Collect about a dentist bill I have never received. Tek Collect informed me that I owed this money. However, when I called the provider, they informed me that I only owed 500 which I still have not received a statement/bill for. The services are one and half almost to two years old. I thought that the provider had to give you a statement and wait 90 days before placing in collections. I also do not know if this is a scam or not.Business Response
