      On May, 26, 2022, Monster Tree Service came out to grind a tree stump for a tree they had previously cut down. While the 2 men were working, they damaged the corner of my concrete stairs, right where the railing was secured to the stairs. They were in structurally sound condition before the stump grinding. I did observe the workers putting a piece of plywood between the stump and the stairway but that was inadequate to protect the stairs from being damaged. I brought this to their attention before they left. I had two contractors come out and look at the damage,as well as a third contractor sent by Monster, and they all have said that any repair would not be permanent due to the location of the damage and the effect that typical winter weather would have on the concrete. I have contacted Michael R****** and Max B***** about this and although they have taken responsibility for the issue, they have refused any compensation for replacing the stairs except for services rendered ($450, including removing some of the grindings). Attempting to go through my insurance was unsuccessful since the replacement cost for the stairs was less than my deductible, with the age of the stairs taken into account. I am asking fair compensation for expenses I have to put out to replace the stairs, which I would not have to do if they had performed the job more carefully.

      *** *******’s steps were damaged during the removal of a nearby stump. This damage dislodged the railing attached to the steps. We sent a contractor to inspect and plan a repair of the steps and reinstallation of the handrail. Our contractor informed us that while the repair and reinstallation could be done, the lifespan of the repair would be limited by the state of the stairs, which themselves had been in need replacement due to their age and condition before the damage occurred. While the railing might stay in place longer than it would have had the damage never occurred, it would not last as long as it would have if installed in steps that were not themselves in need of replacement. We offered to either perform the repair, which would leave the stairs in at least as good a state as they were before the damage, or to refund the amount the repair would cost us. At this time we absorbed the remaining $500 balance that was due to Monster from *** *******, so that he may choose to use that money for either the repair or the replacement, whichever route he would prefer to go.

      I am rejecting this response because:  The only permanent fix to the damage Monster Tree caused is replacement of the stairs which will be in excess of $5000.  Their offer of a temporary repair or $500 is unacceptable.  I would not have to replace the stairs if it were not for their negligence. Doing a patch job DOES NOT return the stairs to their previous condition, a fact that they and their inspector admit.  I will only settle for about half the cost of repair of $2500 since the stair were old, but in perfectly stable condition.
