    This contractor had immigrants replace my roof, they did shoddy job, nails were improperly placed, shingles were tore not cut, shingles were not properly placed, nails were not even put in some places, flashing around chimney was improperly placed, there was 1 inch gap at top and 2 inches where flashing did not even touch. Because of this poor workmanship, and because of leaving shingles, screws, wood in gutters, and stuffing black tar paper in down spouts, water was backing up and going into bedroom, thus in May of 2023 I noticed the water spot on bedroom ceiling which was not there with old roof and did not come through until this contractor did the shoddy job around chimney and the sloppy way of leaving shingles, nails, screws and tar paper in gutters and down spouts which was not found til Spring and in June thus causing the leak in bedroom. It will cost $1,500 to scrap, mud, and repaint the ceiling. I have photos of gutters, spouting, chimney, and bedroom ceiling with 2 witnesses plus me.

    On 9/6/22 ***** ****** entered a sales contract with **** Construction and Roofing LLC. This included an Insurance Allowance Agreement, an Addendum to the insurance allowance agreement, An Assignment of Claim, a Notice of Cancellation, a Notice of Estimate. These forms you the BBB have a copy of.
    Upon entering into this agreement, we did inform ***** Labake that her insurance company completely undervalued the claim. Their initial estimate was $31,529.20. Negotiating this with the insurance company can cause delays. That is stated in our contract with Ms ******.
    On 11/8/22 We were able to successfully obtain an updated pricing from Erie Insurance on ***** ******s behalf for $50,574.54. This took considerable time and effort to accomplish.
    We then immediately installed the roof on the house, shed and workshop which was done in 1 day.  The members of the installation crew where Hispanic. (to call them immigrants is just not nice). The members of our management staff are Caucasian Americans. ***** ****** did express concern about the installation. We met with ***** during the installation and also had the crew come back the following morning to do additional clean up as it was late when we wrapped up the job.
    We met with ***** shortly after the crew cleaned up the next morning. We went around the property very thoroughly and found only a few more nails. (maybe 15) most were behind the shed on the edge of the woods under leaves.  Considering the old roof was metal with shingles under it that means that over 14,000 nails and fasteners came off the roof in tear off.
    I am not sure the condition of the yard prior to getting to the house at about 11 as our crew had guys there around 9 to do additional clean up.
    She stated concern for a plant or 2 that had some very small branches damaged from debris. She also showed me the broken light.
    We have always agreed that even though our contract states we are not responsible for falling debris and we cannot control falling debris we would cover the cost of the plant and light. The plants, I can guarantee would thrive in the spring as these were medium size shrubs with maybe 2 or 3 broken branches, but ***** was adamant about us paying to replace them.   (At this point the plants don’t appear to be replaced)
    She also expressed concern for a bunch of shingles that had not yet laid down and sealed due to the colder temperatures.
    I met with ***** 3 weeks later in early December 2022 and the back of the roof which faces south was completely sealed and so was the top of the workshop and shed. We told ***** that we could manually seal the edge of the gambrel style barn and shed. ***** was not wanting us to touch anything as she was not happy.
    I then filed for a final completion on the roof permit with the city of Zanesville and met the building inspector **** ****** out the property . He also told ***** that the shingles on the front of the home and also the edges of the shed would seal but the temperature would need to increase for that to happen. He told her to let us seal the edges of the shed.
    ***** would not let us seal the edge of the shed roof yet.
    I also went by the home this week and the all the roofs are sealed and have laid down as of 3-10-24. The edge of the shed will eventually lay down but, it really needs manually sealed on a warm day as we have been saying all along.
    We need to be paid for the roofs and overhead and profit on the roofs. The total per the insurance adjuster **** Matthews, with Erie Insurance is $23,586.37. We have been paid $14,151.63. We are owed $9434.74.

    We need to get paid, and we are fine with deducting the cost of the plants and light.
    One more thing to mention. We have an assignment of insurance claim. This means our name was to be on all checks. This means that all funds belong to our company. The homeowner transferred all the rights to the claim funds to us. To not pay us would be considered theft.
    We have always been willing to walk away from the rest of the work and re assign the claim back to Mrs ****** when we have been paid for our work.
    ***** never paid for the work. She then hired an attorney and had an evaluation from another roofer that said there was a small gap in the caulk on the chimney flashing and a few low nails. In the pictrues there were 2 low nails. Once again, we offered to come out and take care of this. But ***** would not allow it.
    The original contract called for us to do all new siding, shingled roofs, and gutters. Since ***** would not let us complete anymore work or even remedy the minor items, we are not responsible for any leak that “she states came from gutters backing up”. It is the homeowner’s responsibility to clean out gutters. Moreover, this leak she states was noticed in May of 2023, June 2023. We did not install gutters to the house. There is no proof as to what caused this leak other than what ***** Claims.
    This roof passed inspection with the building department and the homeowner never paid us. The homeowner converted all funds from having our name on the checks. The homeowner informed us of a minor repair that would be needed that would take less than 10 minutes. The homeowner refused to allow us to do so as that would have allowed us to put a mechanics lien on the property. This is a breach of our contract.

    Hi, I am ***** ..., 74,804, 127, and I'm calling regarding a phone call. I got yesterday, a voice message that said, There that you sent me something that needed a response, and I need a response and four day. So I went on my e-mail, and you can't click on that link, you sent me. It's not highlighted, and nothing happened, so you need to fix that. The, it's regarding 21067649 and like I said, there's no way I can check that out. That's not, it won't. It's not turning a blue color. It won't click.

    And I've asked you before to do something by mail, and I don't like it that you say, give you for days, because I just got out of the hospital three days. What if I was in the hospital? But anyhow, give me a call on this, I can't remember the girls name is Kathleen or something, But anyhow, 21067649, it's **** Construction Company, has different other names aliases, but it's *****, ***** **** construction and I'm ***** ****** ********* and that's it. Call me ASAP.

    On 5/26/22 we went into contract with Ryan Construction for storm damage. The insurance (***** ****) finally agreed for new roofing and siding and gutters that Ryan did. They also covered lattice work, cleaning doors and windows and painting (doors, windows, garage door). They covered window screens to stain and finish the porch/deck. They covered to comb ac fins to detach and reset a fence (a big cost) and Ryan Construction did not do any of that work but took the funds from the insurance company as they did do the work. They received multiple checks from my insurance company, the last of $7,664.38 which after I gave but I wondered what was going on I looked and noticed they owed me. I held the last $3,158.22 check but they still owe me $4004.73 for work not done, I have other contactors that need paid. I have a second property at **** **** ****** * ********** ** ***** where they did the same thing, the did the roof, siding, gutters- but got paid to do a garage roof and painting. They owe me $2,216.37 from that. I am asking for a refund of $6,221.10 to pay for the work done by others. They will not respond to me or my attorney.

    We were very successful in dealing with ***** ******* 2 different properties on 2 separate insurance claims. On both properties after months of working with the insurance companies we got them to agree to pay for all new siding and roofing and gutters and some other miscellaneous things. 

    On the ****** address the claim is not closed and still opened. Our final estimate has always been 58,112.34. We have only been paid $36,613.59. We received 4 checks from the homeowner and their insurance company.

    We have reached out to ***** **** but still dont have their final paperwork or they are still over $21,000 off. 

     

    On the **** ****** property we are looking for a subcontractor that could potential tear the garage down, as that is what the homeowner has requested. We have not received any phone calls from ***** in the last 2 months.

    ***** please call ***** **** and ask them to pay the full estimate as the work is all done and needs paid for on the ****** Property. That should trigger ***** **** to call us, as they have ignored our emails. 

    It is the homeowners responsibility to help us when dealing with their insurance company. Please help us wrap this up. Until our bills are paid, or a proper settlement is finalized, no refund can be talked about or issued. 

    Also I am going to email this response to you and call you. Some times it is really difficult to deal with insurance companies and that can be frustrating. We are really close to wrapping it up, but we need your help as the homeowner and policy holder.
