    We hired Doyle Homes to build our new home in *** ******, ****. We have requested items to be fixed prior to closing on our home and they are refusing to fix the issues or work with us to come up with a solution. On Thursday 5/23 they sent us an email stating that the home is complete and will meet us at the home but only if we sign our final draw request and pay all money due. They also stated that they were stopping progress on the home until we pay final amounts due. If the home is complete as they stated, we are unsure what they are stopping progress on. We have not had our final walk thru inspection (as stated in the signed contract) so no way to verify the items have been completed. They are in breach of contract by not scheduling our walk thru inspection. Only after our final walk thru we can close on the home. We have notified our bank and have tried to contact the builder but they have not responded to emails or voicemail messages.

    The complaint filed by *** & ***** ******
    1.  We have followed our contract.
    2.  May 4th, 2024:  Homeowners, a local Home Inspector along with *** ********, GM & ****** ******, Production supervisor for S.W. Doyle Corporation met at the home located at ** ******* **. *** ******.  At that time, the Doyle Representatives walked through all the home with homeowners and noted any repairs or issues that needed addressed.  The Home Inspector performed his inspection (see attached report #1).  At this time, *** reviewed with the homeowners the development cost that homeowners had agreed to & signed for S.W. Doyle Corporation to perform that specific work for the homeowners.  *** requested payment for all the work that was completed and paid for by S.W. Doyle Corp.  A Check was written out to S.W. Doyle Corp. for those costs.  The amount due was: $18,377.98, for the site development work.  The meeting ended and Doyle Representatives took their notes for issues back to office to be addressed.
    3.  May 6, 2024, *** ******** received a punch list from ***** & *** requesting 31 items to be addressed.  The Home Inspection report only noted 3 issues that were taken care of asap. That day, *** ******** also received a text from *** ****** that he had stopped payment on the check that was given to her for the development costs that were completed and paid for by S.W. Doyle Corp and not a part of the building agreement.  This was a separate agreement with the homeowners when they signed building agreement. (See attached #2)
    4.  All items that were S.W. Corporations responsibility on the punch list were completed & S.W. Doyle requested 3 times to meet with the homeowners at the jobsite to review and homeowners denied meetings as they felt some of the issues that were not addressed to their standard.  Of 31 issues, 23 were resolved by S.W. Doyle Corporation and the remaining are not the responsibility of S.W. Doyle Corp. as per the building agreement.
    5.  Our final response was to be paid in full for all development costs along with our final draw for the home at which time, homeowners emailed lender to let them know they are not releasing any funds at this time. 

    6.  Homeowner did notify ***, that he did send a check for some of the development cost.

    7. 5/31/2024 Homeowner notified *** that they would like to meet at the jobsite on Sat. 6/1/2024.  S.W. Doyle Corp. agreed and also brought foundation representative and stone mason representative with them for the meeting.  All items were addressed, and homeowner agreed to a final closing the following week.

    8.  5/31/24 received notice from lender that their inspection came back 100% completed and funds will be distributed when homeowner signs release.

    8.  6/7/2024.  Steve Doyle, ****** ******, representatives from S.W. Doyle Corp. met with homeowners, S.W. Doyle Corp. received their final draw along with the remaining development cost (with the exception of $2,500.00, for a carpentry finish that cannot be completed until June 19, 2024.  Homeowners are satisfied and have keys, so they are able to move in.   We have worked diligently with this couple to complete & bring them a beautiful home like we have for the past 52 years in homebuilding.  This would be one of our first complaints brought to our attention in at least the past 28 years.

    I am rejecting this response because:
    The island sides have not been addressed yet.  The builder finally agreed to meet with us after filing our complaint with the BBB. The builder still would not fix the issues with the stonework and lot backfill and grading.  The builder ultimately did not address our exterior concerns and we ended up closing on the home because we sold our other home and needed to move.

    Response to rejection:

    1.  The island ends were addressed at the time of the final meeting with the homeowners. The island countertop was changed at the time of measuring for the top from an arched top to a rectangle by the customer, the island panels were already ordered & designed as from picture supplied by homeowner.  After installation, with the top being changed from arch to rectangle, left about a 4" overhang reveal.  This was not acceptable to the homeowner.  SW Doyle Corp. agreed to have new end panels made to fit the new countertop at the expense of the homebuilder.  We have held out $2,500.00 of the closing amount for this to be completed.  The end panels have arrived at the finish carpenter's business, and he is doing some finishing touches and is working on a schedule date to complete the panel changes.
    2.  The stonework, lot backfill, and grading were addressed with the homeowners, Steve Doyle, Gerald Krontz (stone mason) and Craig Menke (foundation company owner) on 6/1/2024.  The yard grading was not the responsibility of the contractor.  See page 6 of agreement.  Contractor backfills foundation 1 (one) time only and that was ***e in February by foundation crew. Homeowner’s responsibilities for landscaping, seeding, finish grading, settling, dirt piles are a part of the agreement.  See page 4.  The stonework is industry standard & is much more professional than their neighbors, which was verified by customer & stone contractor as our subcontractor at the client meeting. Code for State of ****: Sec. 317.1 #2.  Plates, Joists, Studs, Sheathing must be treated if Dirt Line violates 8”.

    We have strived to serve these homeowners and they have a beautiful home. Just as we have in the past 52 years of building homes in NW ****.
