      Description: Constituent had a concrete work done but is having issues with it. The company is Maxima Concrete. He had it done in 2022. He paid 26,312.00 but in 2023 winter spots started showing up so he contacted the company who sent someone out who told him it was salt damaged and gave him the run around.

      Hello,

      ***** ****** ,wife of ****, sent us photos of damages to their driveway, done by an asphalt truck, from another company,  We had just completed a concrete driveway for them and we offered to help them out by power washing and sealing the damaged area. We completed the power washing and sealing work June 2024. The damage was not done by Maxima Concrete and we do not offer any other services regarding resurfacing. We understand that this is was an unfortunate event but we tried to help out with the resources we have.

      Maxima installed a shared driveway with my neighbors in late 2022. During the first rain, my basement flooded. Maxima initially refused to correct the problem in a meaningful way and the owner made false claims about the driveway’s integrity. As a last resort, we noted Maxima was in violation of its contract; two months later, Maxima replaced 2/3 of the driveway and extended our warranty. Problems began almost immediately. After two months, a 40-foot continuous crack developed alongside my neighbor’s foundation. One year later, a parallel crack developed along my foundation. I wrote four letters outlining the problems that had persisted from the original installation and that have developed with the second partial driveway installation. I proposed that Maxima install a new driveway that fulfills their contractual obligations and meets craftsmanlike standards. I researched the issues and consulted with a concrete expert. Maxima refused to correct the major problems without charging us money, so I now request a full refund. Their contract promises to compact the subgrade as required, install expansion joints as needed, slope the new concrete to properly shed water. The slope is flawed. Rain pours from my neighbor’s garage area onto my back patio and makes my pathway dangerous during winter when it freezes. The grate installed the second time does not perform as Maxima promised: it does not extend far enough across the driveway to prevent water shedding onto my patio; the grate is 30 inches shy of covering the drive completely. Rain pools in the middle of the driveway. The second time, Maxima buried our downspouts but apparently didn’t dig deeply enough to prevent cracking above the buried downspouts. This continuous cracking also arises from the fact that Maxima installed no expansion joints along the foundations of our homes, so concrete rubs against the foundations; several cracks have also developed in a glass block window that the concrete presses against.

      I am legal counsel for Maxima Concrete LLC. Please let this letter serve as a formal response to the complaint you received against my client. Prior to the filing of this complaint, I had already communicated directly with Ms. ******* via e-mail communication, as the enclosed documentation will demonstrate. My client agreed to return to Ms. *******’s home to do repairs in the spring or summer of 2025 and she agreed per the attached e-mail dated November 29, 2024. Due to Ohio weather, this is the earliest my client can perform service work on concrete installed outside, which was also explained to her. Ms. ******* did not demand a refund from my client, as she did in her BBB complaint, instead she requested repair work.

      My client will not issue a refund to this client. Per the terms of the signed contract, they are not required to do so. Regarding the sidewalk section between the garages that has a small belly in it, they have offered to cut it out and replace it. My client is also willing to make the color of the concrete more uniform. Maxima confirmed they installed expansion joints where they deemed appropriate, and the slab has wire mesh throughout and residential poly fiber in the concrete.

      My client will not replace the entire driveway solely at their expense. Some items Ms. ******* complains of were not included in the original signed contract and will require additional payment by the homeowners. These requests include alteration of slopes, and more drains added. As explained to Ms. *******, my client is willing to negotiate, but those actions would incur new costs per terms of the contract. As the contract clearly states, in paragraph 2(k), “Any changes in project scope differing from estimate sheet will result in appropriate change of price.”


      My client is a reputable and ethical Ohio business who stands behind their work. The owner of the business, as well as management have continued to communicate with these homeowners and returned to the project to discuss the requested repairs, as well as perform additional work. They want to resolve this matter amicably and fairly with the homeowners. My client will follow the terms of the signed contract. They will return in the spring or summer of 2025, as agreed, and complete the work they already agreed to do with the homeowners through me as their legal counsel.       I am rejecting this response because we are in exactly the same place as before I wrote a formal complaint to BBB. I had tried on four separate occasions to detail my concerns with specifics from the contract and subsequent written promises the company made to no avail, which is why I ask for a refund now. I had hoped Maxima would make right what is not right without a formal complaint. Based on Maxima's own assessment of the problems with the driveway and an assessment from an outside concrete expert, I believe the company has not fulfilled all of its contractual obligations or installed the shared driveway in a workmanlike manner. Maxima's promise to return in Spring 2025 will be the third attempt to install correctly a short pathway between the two garages; the logic of correcting the slope to eliminate pooling water applies to other parts of the driveway that Maxima has ignored. In addition, the insufficient width of the drain Maxima installed the second time across the driveway between our two homes means water still pours into my patio when it rains because the slope is incorrect. The failure to install adequate expansion joints between the concrete driveway and our house foundations has created cracks in my glass block window that have developed in the past few months and two continuous and parallel cracks in the driveway alongside the foundations of our homes, of 40 and 30 feet respectively.  I include the original documents detailing these issues.

      Maxima's position remains unchanged. ****** ******* agreed through Maxima's legal counsel in to have Maxima return in the Spring of 2025 to perform specific work as explained in the initial response creating a valid contract between Maxima and Ms. *******. Maxima performed significant work on this project and will not issue a refund. As previously stated in both e-mails to Ms. ******* and in Maxima's formal response to this complaint, any requests for services outside the scope of the original contract signed by BOTH parties will require additional costs.       I am rejecting this response because it avoids addressing in a meaningful way the issues that I raised first with Maxima itself in four separate letters and more recently twice through the BBB. Unfortunately, nothing has changed. Maxima's response ignores promises of both the original and amended contract (which I have already attached). I had wanted Maxima itself to redress these legitimate concerns, without outside intervention, but when Maxima said the company was going to charge me for work that they should have already performed correctly, I contacted the BBB for help. Since the company continues to refuse to live up to their contractual promises, I had no other choice except to ask for a full refund. The legal counsel's response claims that our money will not be refunded because the company has performed work on the driveway already, but this makes no sense to me because some of the work, as I have detailed, is not up to Maxima's own contractual promises or to workmanlike industry standards. Maxima has done some of the work incorrectly (the grate is insufficiently wide to correct for the incorrect slope of the shared driveway that pours rain water from my neighbor's garage area onto my patio; rain water pools in the middle of the driveway); in another case, Maxima has failed to do inexpensive, standard work of the concrete industry (install expansion joints between the two house foundations and the cement driveway to avoid problems that have already developed such as my glass block window cracking and two 30-foot plus cracks developing alongside the house foundations themselves). I confess that I am unable to understand why I should be financially responsible more than once for getting the company to perform their work correctly; we've already paid almost $20,000 for a driveway that neither looks nor acts like other people's new driveways. Maxima's promise to return in May 2025 is to correct FOR A THIRD TIME a pathway that has been INSTALLED INCORRECTLY TWICE before, so it is not a new contract in any sense that I understand. I will say in conclusion that my neighbors and I have owned homes for over 25 years each, and we have never had a problem with any contractor.

      I contracted with Maxima Concrete LLC to replace my concrete driveway and several feet of sidewalk leading into our home. The initial crew removed the concrete on Aug 6 and prepped for the replacement. I had to ask the crew to return after the initial removal to compact the base in a uniform way. The did that approximately a week later. It wasn’t until 16 Aug that Maxima returned to pour the concrete. This was after delaying for 3 days due to a rainy forecast. We never got that rain. So on Monday the 16th August the crew arrives on time at 7:00am followed by the concrete supply truck. The crew from Maxima worked for the next 3 and half hours pouring and finishing my project. It was however sprinkling rain at the time. I asked the job Forman about the rain and he assured me it would not be an issue. It was. After they finished the concrete and shortly after they left I noticed pot marks developing in the entire project less the approach. I took multiple pictures and video for the record. After verifying with other Concrete professionals, it is apparent the entire concrete has been compromised and will be subject to advanced cracking due to the pot marks left behind in their product. I have contacted the company the following day to provide pictures and details. I was assured the owner is a perfectionist and will want to see the project results. Multiple text messages to the company and finally a response that the owner was out of the country. His return would be the following week. Again the assurances that he would come look at the results. Another week goes by an no communications from Maxima Concrete. I text again and received a response the owner had developed Pnemonia and I would be his top priority once he has recovered. I file this on the 21 Sep and have yet heard from Maxima ownership.

      In our industry we have a lot of variables that indicate the timing of our projects. Weather is always the biggest battle. In this specific case a tree dripping water from a previous rain shower left spots on new concrete surface. We did come to a resolution with the customer and will stay in connection with the customer for any further issues. The follow up appointment took place on 10/4/2024.

      Colored concrete patio completed in October 2021. We choose a dark cedar stain, before long the color desegrated to a pale tone. Maxima came out and completed a spray treatment which we were told would bring the color out. It did not. After many conversations back and forth, Maxima did agree to replace the whole thing. When the concrete was laid the first time, our yard was destroyed because of the equipment used to get to the backyard. We spent $1000 to repair our yard. We have decided that the pain of having it replaced was not in our best interest because we lacked the confidence in Maxima to correct the problem. We thought a much less expensive solution would be to ask for a partial refund (enough to cover it with rugs and/or cover it with a profession epoxy company (cost is $2800)). But they refused to offer a partial refund for their mistake and would only replace it. If we didn't agree to replace then there is nothing more they could do. Bottom line- buyer beware of coloring the cement, it will probably not be the color you wished for, instead be out several thousands of dollars regretting your choice.

      Maxima Concrete offers colored-only concrete as a customer choice.  This involves purchasing color pigment from a local decorative concrete supplier (Deco-Crete), handing the color to the ready-mix supplier truck driver, who adds it to the truck and mixes it and then pours the colored concrete out for us to finish.  Unfortunately, Maxima has zero control over how close the color matches what the customer picked out while at Deco-Crete.  We have never guaranteed the final color on these types of projects for this reason.  Our proposal, which was signed by the customer, states "There is no guarantee or warranty for any color or color variations for any concrete project."  I have included a copy of the proposal as well as a signature page with the customer's signature.   

      When the customer initially contacted us about their displeasure with the color of their patio, we explained to them again that we do not warranty color for this reason.  However, they told us this was not acceptable because of the amount of money they spent on their patio.  We do not want our customers to be unhappy so we offered to power wash and reseal the patio with a color-boost sealer (which is what was recommended by Deco-Crete).  However, that did not resolve the issue for them.  After telling them we do not warranty the color, and there was nothing further we could do, they repeatedly called us to push us to resolve the issue.  Because we don't want unsatisfied customers, we finally offered to fully replace their patio.  They decided they did not want that option and instead wanted us to refund them the $2,800, as stated in the complaint.  Maxima Concrete does not offer refunds on our projects. Also, as stated above, their issues did not relate to the concrete work itself, but instead the color.  Therefore, Maxima does not feel a refund should be given in this situation.  Unfortunately we were not able to come to a resolution that was acceptable to them.

      I am rejecting this response because: The company did not give a solution in their reply, only placing blame on the customer. To place blame on the customer and the vendor, Deco-Crete is appalling.  We hired Maxima Concrete to do a job, not Deco-Crete.  It is up to the employees of Maxima; installing the patio to have experience on how to mix the cement. 

      I am not an expert and saw immediately that something was off; but the worker with broken english guarenteed that the "color will rise to the top". I took his word for it and they continued with the project. 
      Colored cement is nothing new and when it is done properly by knowledgeable people laying the concrete, it can turn out perfectly.  Therefore, it is Maxima Concrete fault that the employees did not do their job accurately.  
      The owner states "Maxima has zero control over how close the color matches what the customer picked out while at Deco-Crete" Again, blaming the customer who hired professionals to perform a task that they said they could do, 
      is not the customers fault,  Maxima Concrete has absolute control of getting the color correct, therefore the blame lies with them.  

      Our first mistake was trusting this company to produce a product that we payed thousands of dollars for.  
      We read and understand the contract, however can a company simply rely on the last sentence of their contract to nullify them of any wrongdoing?  We understood this sentence to mean that a slight color difference (one shade, or maybe even two shades), 
      but this is at least 10-15 shades from what we agreed to in the contract.  However, we ordered a DARK cedar color (see attachment- Terra Cotta and the results we received was a PINK patio.     


      Maxima Concrete states " we offered to power wash and reseal the patio with a color-boost sealer (which is what was recommended by Deco-Crete). However, that did not resolve the issue for them." This is a correct statement, we were told "let's try this first", which meant to us, they were trying to correct their mistake. Placing blame on a vendor, is not the solution here, taking responsibility for the poor craftmanship is the right thing to do.  Hiding behind this "warranty" is not an excuse on the 15 shade difference that was picked out, again do not do it if you can not produce the product!  We would have been fine with that and went with the recommendation of the professionals
      who lay the concrete.  Do not blame us or your vendor, that is insulting.

      The reason we have decided we didn't want to bust up the concrete and lay a new one is because of the lack of trust in their craftsmanship and work ethics.  Our yard had to be repaired once the workers left deep marks in our yard.  Plus, not only is the cement pink, the workers splashed this concrete on the wall of the house, so now we have pink on our house. We had our yard re-seeded and because the patio was so high up of the ground, we paid to have some one put more dirt and edge around it.  Costing us $1000.

      We don't think our request for a partial refund was unreasonable to help us pay for rugs or epoxy covering. My question to the owner, Flavio P, I want to know if you are proud of the results and would post our patio to your website as an example of your work or do you mind if I share this patio to many social media outlets and tag you? I have seen all of the colored patios completed on your website, surely you will post this one as well, correct?  I went ahead and attached some photos if you would like to use these.

      We had this company replace some curbs on our driveway. Within 4 months, cracks developed on both sides of the driveway curbs around the drains that were installed. We called them and they came out in December and said they would have someone come out in the early spring to tell us what they were going to do to correct the issues (these were more than hairline cracks, which they said could occur over time). I finally had to call them in May and they could never give us an answer as to how they were going to repair the areas. They never gave us a definite answer. We paid them over $7000 and have never received any satisfaction on how this is going to be resolved. We even suggested refunding us half of the money so we could have some other company repair this mess.

      We have been working with Sharon to correct her project to her satisfaction.  We have been emailing back and forth with the customer to satisfy their pre-visit concerns (i.e. having a specific plan of what to remove and replace).  We last spoke with the customer vis telephone approx 3 weeks ago. We understand the customer is frustrated with the wait.  We are prepared to perform any needed corrections the week of June 12th and have contacted the customer today (6/9/22) with this information.  We will continue to work towards a resolution to the customer's concerns.

      Per our contract we were explained that 4 inches of concrete would be used for our driveway. After completion the driveway is now 12 inches above the ground and poses a major tripping hazard and car damage hazard come winter if we were to get too close and drive off the edge. I have never seen a driveway sit a whole foot above the ground and after speaking to a couple landscaping companies there is nothing that can be done to alleviate the gap because the driveway sits too high and and as it slopes downwards towards our back porch would cause our basement to flood

      On March 16, 2022, and at Mr. *****’s request, Maxima drafted a work proposal for the construction and installation of a new concrete driveway and step landing.  The proposal is attached to this email.  The proposal contains a detailed, itemized description of the scope of work and estimated cost of $6,920 for the driveway and $651.00 for the step landing.  Mr. ***** agreed to the terms, signed the proposal, and authorized Maxima to begin work.  A copy of the signature page of the proposal Mr. ***** returned is attached to this email. 

      Work started on or about May 4, 20222.  Work was completed on or about May 12, 2022.  A picture showing the completed project is attached to this email.  Maxima fully performed its obligations under the contract with Mr. *****. 

      However, Maxima is aware of Mr. *****’s dissatisfaction with the completed project because the driveway is higher off the ground that he expected.  As is necessary with a driveway project like this, the concrete was poured at a slight slope to prevent water from pooling in the summer and ice accumulation in the winter.  The slope resulted in a raised edge towards the back of the driveway.  While this problem is not a defect in the finished project and was an unavoidable consequence of the terrain and conditions of Mr. *****’s property, Maxima worked with Mr. ***** to address his concerns by backfilling his property with additional topsoil to help reduce the height of the driveway edge.  A picture of the completed backfill is attached to this email.  Maxima remains willing to work with Mr. ***** in a reasonable manner in hopes that he will be satisfied with the project.  Unfortunately, he called his credit card company, who took the funds back from us (which we are also responding to) and has now placed a complaint with you.  Please feel free to call or email me directly for further information.
