    We hired ***** ***** to build an addition and renovate the first floor of our house; to replace all windows and doors; install insulation and replace the siding on the entire house. He began work in November of 2020, estimating it would take 68 months, but he didn't finish until February of 2023. Upon moving back into the house, we noticed loud banging and popping noises. We told ***** and he came by once to add crush blocking in the basement, but he was dismissive of our various concerns and didn't respond when we told him we were continuing to hear noises throughout the house. We hired an engineer to diagnose and assess the issue; he found dangerous structural issues, concluding they were the direct result of Darrys work. This forced us to move back out of the house. Temporary walls and supports had to be installed immediately to prevent the second floor and addition from falling. (The addition he built wasn't sitting on any foundation and wasn't properly attached to the existing house.) We had to hire a new contractor to re-do and fix most of Darry's work, which has cost us $80,000 already, with more work to be done, estimated to cost another $100,000. This entire situation is a direct result of ***** not following architectural plans (using correct hangers and hardware) or basic/accepted construction practices, as well as generally sloppy workmanship. We have thorough photographic documentation and engineer and mold reports, which we have shared with him, proving these issues and his culpability. We tried resolving this with him and worked with a lawyer to try to mediate, but ***** has not responded since his insurance denied his claim. He has't compensated us in any way for the difficult financial strain he has imposed on us, not to mention the four years we have had to live with construction on our house. We're hoping he will make a good faith effort to make things right without our having to sue him, as that would be unpleasant and expensive for everyone.

    The time line given in this complaint is totally inaccurate. I  never gave them a time line. All work was inspected by an independent third party (the city of ********), all construction was passed by the city of ********. I did show up to put in crush blocks, at that time I took pictures and told them to keep me informed. After that I did not hear from them until I heard from their attorney. I was advised to not contact the homeowners at that time.

    I am rejecting this response because: 

    None of this is relevant to the basis of our claim and all of the work done by ***** was NOT inspected. In fact, we had a meeting with the head of Hilliards Building Department, who informed us that the only part of our project for which ***** had permits was the addition. This means that a majority of the work done was never inspected. Furthermore, the passing of inspections is not a guarantee that work was done properly. Ultimately, it is the responsibility of the contractor doing the workDarry Yoderto make sure it is done correctly. In this case, so much structural work was done incorrectly that our house started to collapse and no amount of crush blocking was going to be sufficient in fixing the enormity of the problems. We did indeed reach out to ***** after he added the crush blocking, but he never responded to us and had been dismissive of our concerns up to this point. This is why we felt is necessary to seek the advice of an engineer. And its a good thing we did, as our house was literally collapsing. No one other than ***** was responsible for this.
