On 03/19/24 of this year we contracted with CDM Home Solutions (Also known as ****** *****) to install a fence in our back yard. We live in New Albany and they require a permit from the City and a approved review from our HOA. We were assured all was well and had them install our fence. We paid $$7485 for materials and labor. After the fence was installed, we got a call from the HOA telling us they never received a submission for approval. They also informed us the fence was installed improperly according to their guidelines. Since then, we have been unable to reach Conner M***** (the owner) or any other person at CDM. We have left several messages and texts with no return communication. We would like them to move part of the fence to accommodate the HOA or reimburse us for any expense that may occur if we have to hire another company to move the fence.

    Business Response

    Date: 06/03/2024

Good afternoon. I apologize for the delay in response. I had a family emergency that pulled me from work for several days. The work mentioned was completed by my company. Upon initial on site estimate we discussed the process of permit applications with the customer. We notified them that we submit with any townships requiring permits but they would be required to file with the HOA as they are the ones in contract with the association. When brought up Mrs.******* waved me off. Upon approval of the project we had another discussion in which I brought up them needing to file with the HOA and was told it would be handled. Our initial layout was declined by New Albany. When I reached out to discuss with the owner we adjusted the side New Albany needed moved. The customer had us extend a different side to make up for the lost space. Upon this conversation I once again brought up the HOA and was told it was taken care of. Upon completion of the project customer was satisfied and submitted final payment. When they received notice from the HOA that the fence was against regulation I discussed with Mrs.******* requesting a hardship and to notify me of the response. At this point my family emergency occurred. I had my father let the customer know what had happened and that I would reach out when I could. From that point they attacked my business online, put my personal home information online, and left threatening voicemails. Although it was on their end that the HOA was not contacted I was initially willing to help them with the issue. With the horrible treatment myself, my guys and my family received along with the threats we will not be able to do so. My lawyer has recommended no contact for safety reasons unless there is a warranty issue. At that point we will have a police escort to the property to hold up our end of the contract.

Was having a fence put in & was told they would use a tension bottom which was only done in a few places from making the fence wiggle. In one area the fence doesn't even touch the ground. I want gate opening like it was. They were paid by bank check when job was done. Tried getting in touch since about June 27th either by phone or text & have gotten no reply. All I want is for them to finish the job & make it right
