Had vehicle towed to a mechanic garage called Fix it Fred on Raft rd Canton Ohio to have checked out it wouldn't run paid $400 just for them to run test that they turned around and told me they did not run because they knew the problem was the motor. They stated in order for them to begin making the repair of replacing the motor with a new crate motor I would have to give them $2,500 upfront which was half the cost of the motor . They knew I was trying to get approved for a loan I even tried through there loan process with no luck . As I was trying to figure out where to get the upfront money for the repair they went ahead and replaced motor with new one without any cost upfront or permission or even notifying me of the work they had done I never signed or permitted anything other than a scan to tell me what was wrong which they never ran nor did I get the $400 back . They turned around and put a mechanic lien on the car. Then offered to sell it back to me for $6,000. I didn't know what to do about this I thought I was just out of luck but was told by a friend what they have done is illegal.Business Response

Here is the timeline of events.
5/1/23-***** towed his vehicle in. He told us the vehicle cranked but would not start.
5/2/23-We sent *****'s report to him. We told him we will have to replace his engine then see if his vehicle starts or not, since the engine was locked up. He told us he had an extended warranty. We contacted them and they wanted oil change receipts to verify that the vehicle has been maintained. Since he didn't have any receipts, they declined coverage.
5/4/23-***** authorized replacing the engine in person, and paid us $400 cash towards the repairs. He told us he was going to secure financing. We ordered the engine for his car.
5/8/23- ***** applied for financing thru one of our vendors
5/11/23- ***** were declined for financing.
5/30/23- We installed the replacement engine and *****'s vehicle cranked but wouldn't start. It was setting security codes so we texted & called ***** asking for a second key so we can access the security module on his vehicle.
We never heard back from ***** so we called and texted you several times.
10/23/23-***** called over the weekend and left a barely audible voicemail from a different number. Since we use a VoIP system, the voicemails are transcripted. I wasn't able to hear or understand what he was saying. The transcripting software showed us that the caller was ***** *******. We looked at the caller ID and texted the new number. We asked for the second key again, and ***** said you would come by the next day to give us the second key
10/24/23-***** brought us the second key.
10/25/23-***** texted asking to pickup his license plate (which can't be used on another vehicle until this vehicle's title is out of your name). This was the first sign that ***** was abandoning the vehicle.
10/26/23-***** came and got his license plate. That showed us ***** wasn't interested in picking up his vehicle.
After that I contacted the bank that has a lien on the title. They weren't interested in paying over $5k for a car that won't run, so they told us to extract the title from the state of Ohio. Part of that process is us sending ***** a certified letter, stating how much he owes and how much it would cost for you to pickup your vehicle. That's what he's referring to as us offering to "sell your car back to him"
***** has abandoned his vehicle, and not responded to our communication to the point where we gave up. One of his friends told him that what we're doing (expecting him to pay for authorized repairs) is illegal. When he and his wife left 1 star reviews on my Google business page, they talk about how they don't have any money and are dealing with health problems. They are trying to get back the $400 that they put down on the repairs. I'm stuck with a vehicle with a $5000 outstanding bill that doesn't even run. I'll have to get the title from Ohio Title Bureau, and scrap the vehicle and NOT get the $5000 that ***** authorized. We NEVER used to ask for customers to give us money until we were done with repairs. Because of what ***** did to my business, I've changed that policy.
Now if someone authorizes over $2000 worth of repairs, we ask for 1/2 down before we start repairs.
I'm sorry that ***** and his wife are having financial and medical issues. That doesn't change the fact that ***** authorized repairs, then didn't pay for it. Him coming to give me the second key, and picking up his license plates showed that he was abandoning his vehicle, making his broken vehicle my problem.Initial Complaint

I dropped my vehicle off at Fix it with Fred on 5/24/2023 at 7:50am. The guy I spoke with name was Ty *****. He came out, took pictures of my car and said that my car was all checked in and that he was going to call me when they are done running test. I said ok that’s fine. A couple hours go by and I called up there, spoke with Ty once again, asking him how things were going and he told me that everything was fine, engine and transmission but they couldn’t quite figure out why it was having the rough idling and stalling issue so they were going to keep testing. At 5:29pm, I called and spoke with Ty and asked him if they were going to keep my car and that’s when he told me yea because they couldn’t figure out what was going on, I said ok no problem. Not one time during the conversation did he mention about any fees. On 5/25/2023, I go to the shop to check in my car. As I’m standing at the desk talking to Ty, I asked him if they ran any test on my fuel and he said no because my car starts up and I’m like ok. So I’m asking him what test have they ran on my car because it’s been 24hrs and they still didn’t know what was wrong. Now, Ty tells me that 2 different mechanics thinks it’s my engine and the other thinks it’s my transmission so when I Beckham questioning him about what he spoke about the day before and how now it’s either or is when Ty began getting irritated. I told Ty that I would like to take my car elsewhere to get it looked it and that’s when he stated that I could take my car for 184.39 and I’m asking what is that for and he said for the test they ran. I pay the 184.39, get my car and leave. I then take my car to another mechanic and he puts his scanner on my car and immediately knew that all 4 cylinders was blown and I had a cracked motor mount. I called Fix it with Fred and once again asked what test did they run and he couldn’t tell me so my mechanic proceeds to explain what he found and Ty hung up the phone. When Chandra left our shop, she called within an hour and yelled at my service advisor because she claimed that another shop diagnosed her car in 5 minutes. The other shop hadn't fixed the problem yet. I told my service advisor to refund her money. I help him walk thru the process of deleting her transaction from my card machine before the batch settled overnight. We reviewed the pending batch, and verified that her transaction was gone from my batch. As you can see in the receipt that she sent in, she was refunded. I've attached screenshots from my credit card processing software where I blurred out my other customer's information. One screenshot shows all authorizations done at my business on 5/25/23. You can see her authorization of $184.39 matches the last 2 digits on the receipt she sent in. You can see in the other screenshot of the nightly settlement that her transaction didn't go thru, therefore she wasn't charged. I also talked to my credit card processor who verified that her transaction didn't process. I also checked with our bookkeeper who verified there weren't "extra" funds deposited on 5/25/23 that would have been Chandra's money that showed refunded in my system.
Please ask Chandra to produce a document from her bank showing that we charged her.
I know she can't produce that because I never received funds from her.Customer Answer

They clearly haven’t refunded my money and as far as me telling, I didn’t raise my voice one time and when I called in, the other mechanic was in the process of fixing my car. I can have the other mechanic and my witness both wrote statements on how rude they were to not only me but to the other mechanic. As soon as he started asking questions, Ty ***** began stumbling over his words and couldn’t produce any codes and that’s when he hung up
