    Hired contractor on 5/16/22 for radon mitigation, signed contract and paid $100 deposit. Work was scheduled for 6/9/22; however contractor was called on 6/8/22 to advise him that due to heavy rain on a newly planted yard, he would sink in several inches unless he could lay down plywood, (he declined, and,) therefore best to reschedule. After 2 months, contractor remained evasive of a reschedule date, and ultimately on 8/8/22 told us to hire someone else - and, he would not refund the deposit. The contract does not outline any such provision regarding deposit, and, with his refusal to complete the job, we are owed a refund of the $100 deposit we paid.

    RESPONSE TO COMPLAINT FILED BY ***** ********

    Customer used our online booking software to reserve a specific date/time for installation by paying a non-refundable scheduling deposit.  Customer agreed to the terms of the deposit and signed our contract and addendum (attached).  Two weeks after booking, the night before the work was to be performed, the customer canceled unless we were willing to bring multiple sheets of plywood to create a pathway and work-area.  It is the customer's responsibility to have their home ready for our project; it is not our responsibility to acquire/transport/dispose of hundreds of dollars worth of wood to complete a simple job with only 15 hours notice.  Customer was made aware that our upcoming projects would prevent us from scheduling a new date for at least 8 weeks.  Customer is unwilling to pay a new deposit to secure a new date, and we are now unwilling to re-schedule a very rude, spiteful customer who refuses to acknowledge that they agreed to the terms of the contract/addendum in the first place.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

     

    Screen shot about non-refundable deposit was not remembered, nor was it part of the contract document.  However, this business owner has been slandering and threatening us, which is worth forfeiting the deposit to rid ourselves of such an unprofessional business and unpleasant experience.
