      On October 20, 2023, ******* ***** from Wichita Tree service provided me a bid to trim three trees in my backyard. His bid was $1,400. When I called to confirm the bid, I suggested that the bid include a second pear tree located in my front yard. ******* said it should not take more than an additional hour’s work. We agreed on an additional $100, bringing the total bid to $1,500. Two men arrived on November 8 to do the work. I peered out the window several times to see what was going on and remember thinking “not much is going on”. Later in the day I received an e-mail with an invoice attached noting that payment was due that day, so I paid the bill using their on-line payment service. Sometime after the crew left, I went out to make a cursory inspection. I noticed the rather small stack of limbs in my front yard and thinking that wasn’t much for $1,500. I also noted that the crew didn’t work for much more than an hour. I called Wichita Tree Service the next day expressing my concern over the amount of the bill. *** ***** agreed to come out and inspect the work, which I think he did that day. After observing the work the crew had done he agreed to reduce the bill by $500, to which I agreed. After several days had passed, I called to check on the status of the refund and ******* agreed to bring the check out to me, but I said to just drop it in the mail. That never happened. I subsequently called numerous times to request the refund, always to hear that I was going to be paid, or that the owner, ******* would call me back which he never did. On the last call I said that if they were having a cash-flow problem I was willing to work with them, but I needed a firm commitment of when I could expect payment. Again, I never heard back from them. One month after the service was completed, I still had not been paid so I sent a letter to them noting that if I was not paid by December 15th, I would have to commence other means of obtaining my refund. I received no response.
